1. Acceptance of These Terms

These Terms and Conditions (“Terms”) govern the use of the website everestscaffoldingsolutions.com.au (the “Site”) and the provision of scaffolding, staircase, lift shaft infill and ladder access services by Everest Scaffolding Solutions (“we”, “us” or “our”), located at 2/24 Reid Street, Ardeer, Victoria, Australia.

By accessing our Site, requesting a quote, or engaging our services, you (“customer”, “you”) agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Site or engage our services.

2. Our Services

Everest Scaffolding Solutions provides hire, installation and dismantling of temporary structures, including:

Scaffolding; Staircases; Lift Shaft Infills; Ladder Access.

All services are provided to residential, commercial and industrial projects within our service area in Victoria, Australia, or any other location specifically agreed with the customer.

3. Quotes and Pricing

  • Quotes provided through the Site, by phone, WhatsApp or email are estimates based on the information supplied by the customer and do not constitute a binding offer until confirmed in writing by Everest Scaffolding Solutions.
  • Final pricing may vary depending on actual site conditions, access, hire duration and safety requirements identified during an on-site inspection.
  • All prices are in Australian dollars (AUD) and include GST, unless otherwise stated.
  • Quotes are valid for 30 days from issue, unless a different period is specified.

4. Formation of Contract

A binding contract is formed when:

  • You accept a formal quote in writing (email, digital signature, or a recorded verbal confirmation); or
  • You make a deposit payment, or we commence providing the service at your request.

We reserve the right to decline any request for services, including on grounds of safety, site access, availability, or outstanding prior payments.

5. Customer Obligations and Site Access

To enable a safe and compliant installation, the customer must:

  • Provide safe, timely and unobstructed access to the site on the agreed dates and times;
  • Disclose known site hazards, including overhead power lines, unstable ground, asbestos or other risks;
  • Obtain any council or footpath/road occupation permits required for the scaffold installation, where applicable;
  • Ensure the area is free of vehicles, materials or obstacles that would prevent safe erection or dismantling;
  • Not permit use of the scaffolding by unauthorised personnel, and not exceed the specified working loads.

Everest Scaffolding Solutions is not liable for delays, additional costs or cancellations arising from the customer’s failure to meet these obligations.

6. Regulatory Compliance and Safety Standards

All scaffolding is designed, erected, maintained, inspected and dismantled in accordance with:

  • The AS/NZS 1576 series of Standards (Scaffolding);
  • AS 4576:2020 (Guidelines for scaffolding);
  • The Occupational Health and Safety Act 2004 (Vic) and its supporting regulations (OHS Regulations 2017);
  • Applicable codes of practice issued by Safe Work Australia and WorkSafe Victoria.

All scaffolding work above 4 metres will be carried out exclusively by personnel holding a High Risk Work Licence, as required by law. Scaffolding will display a status tag (green/amber/red) and will be inspected before first use, after any alteration, and following adverse weather conditions.

The customer must not alter, move, extend or modify the scaffolding under any circumstances. Any unauthorised alteration voids our responsibility for the safety and structural integrity of the scaffolding, and may result in additional charges and/or customer liability for resulting damage or injury.

7. Payment Terms

  • We may require a deposit before commencing services, as specified in the quote.
  • The balance is payable in accordance with the terms shown on the invoice, generally within 7 to 14 days of issue, unless otherwise agreed in writing.
  • Overdue payments may incur interest and/or suspension of further services until the account is brought current.
  • Accepted payment methods will be indicated on the relevant invoice.
  • Pricing may be subject to variation for additional works not contemplated in the original quote, which will be communicated and agreed with the customer before being carried out, wherever reasonably practicable.

8. Hire Duration, Extensions and Cancellation

  • The hire period begins on the installation date and ends on the agreed dismantling date.
  • Extensions to the hire period must be requested in advance and may incur additional charges at the applicable rate.
  • Cancellations or rescheduling requests made less than 48 hours prior to the scheduled installation date may be subject to a cancellation fee, as set out in the quote.
  • Everest Scaffolding Solutions reserves the right to reschedule installations due to adverse weather or other safety-related circumstances, at no additional cost to the customer.

9. Insurance and Liability

  • Everest Scaffolding Solutions maintains public liability insurance appropriate to our business activities.
  • The customer is responsible for insuring their own property, materials and existing structures on site during the hire period.
  • We are not liable for damage arising from: misuse or unauthorised alteration of the scaffolding by the customer or third parties; site conditions not disclosed prior to installation; or events of force majeure (see clause 13).

10. Consumer Guarantees (Australian Consumer Law)

Nothing in these Terms is intended to exclude, restrict or modify the rights you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)), including the consumer guarantees that services will be provided with due care and skill and will be fit for the agreed purpose. To the extent permitted by law, our liability for breach of a non-consumer guarantee for goods and services is limited, at our election, to re-supplying the service or paying the cost of having it re-supplied.

11. Limitation of Liability

To the maximum extent permitted by law, and subject to clause 10, Everest Scaffolding Solutions’ total liability to the customer for any claim arising out of these Terms or the provision of services will not exceed the total amount paid for the specific service giving rise to the claim. We will not be liable for indirect, consequential or business losses (including loss of revenue, project delays, or loss of business opportunity).

12. Indemnity

The customer agrees to indemnify and hold harmless Everest Scaffolding Solutions against any loss, damage, cost or third-party claim arising from: (a) the customer’s breach of its obligations under these Terms, including unauthorised alterations to the scaffolding; (b) inaccurate or incomplete information provided about the site; or (c) misuse of the scaffolding or structures by the customer or third parties under their control.

13. Force Majeure

We will not be liable for any failure or delay caused by circumstances beyond our reasonable control, including extreme weather, natural disasters, government restrictions, labour or material shortages, or supply chain disruptions.

14. Intellectual Property and Website Use

All content on the Site (text, images, logos, design) is owned by Everest Scaffolding Solutions or used under appropriate licence, and is protected under Australian intellectual property law. You may not reproduce, distribute or modify content from the Site without our prior written consent. The quote request form and other Site functionality must be used only for lawful purposes and in good faith.

15. Privacy

The collection and use of your personal information is governed by our Privacy Policy, available on the Site, which forms an integral part of these Terms.

16. Dispute Resolution

In the event of a dispute, the parties agree to first attempt to resolve it in good faith through direct negotiation before commencing any legal action. If the dispute is not resolved within 30 days, either party may proceed to mediation or to the courts of competent jurisdiction under clause 17.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Victoria, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of Victoria, Australia.

18. Changes to These Terms

We may update these Terms and Conditions from time to time to reflect changes to our services, business practices, or applicable law. The current version will be published on the Site with an updated “Last reviewed” date. Continued use of the Site or our services after changes are published constitutes acceptance of the updated Terms.
