1. Introduction

Everest Scaffolding Solutions (“Everest Scaffolding Solutions”, “we”, “us” or “our”) provides scaffolding, staircase, lift shaft infill and ladder access services, operating from 2/24 Reid Street, Ardeer, Victoria, Australia. We are committed to protecting the privacy of everyone who visits our website, requests a quote, or otherwise deals with us.

This Privacy Policy explains how we collect, hold, use and disclose personal information, and it has been prepared in accordance with the Privacy Act 1988 (Cth) (“Privacy Act”) and the 13 Australian Privacy Principles (APPs) set out in Schedule 1 of that Act, together with the Spam Act 2003 (Cth), the Do Not Call Register Act 2006 (Cth), and applicable Victorian privacy law.

Many small businesses (annual turnover of $3 million or less) are currently exempt from parts of the Privacy Act under section 6D. As a matter of good practice — and in view of ongoing federal reform to the Privacy Act, including the statutory tort for serious invasions of privacy (in force from 10 June 2025) and further changes expected from December 2026 — Everest Scaffolding Solutions handles all personal information in accordance with the APPs regardless of whether the small business exemption applies to us.

By using our website or otherwise providing personal information to us, you agree to the collection, use, storage and disclosure of that information as described in this Policy. If you do not agree, please do not provide us with personal information, noting that this may limit our ability to respond to your enquiries or provide our services.

2. Personal Information We Collect

The type of personal information we collect depends on how you interact with us. This may include:

  • Identity and contact information — name, email address, phone number and postal or site address;
  • Enquiry and project details — the type of service you require (Scaffolding, Staircases, Lift Shaft Infills or Ladder Access), project location, site conditions and any comments or messages you submit through our “Request a Quote” form;
  • Communications — records of calls, emails, WhatsApp messages, and Meta (Facebook/Instagram) Messenger conversations you have with us;
  • Marketing and lead form information — details you submit through Meta Instant Forms, Facebook or Instagram lead ads, or Google Ads lead forms, including any privacy or consent disclosures accepted at the point of submission;
  • Technical and usage information — IP address, device and browser type, pages viewed, referring URLs and interaction data collected automatically through cookies, Google tools and the Meta Pixel (see section 6);
  • Employment information — if you apply for a role with us, information contained in your application, resume and references.

We do not intentionally collect sensitive information (such as health information) unless you volunteer it — for example, in the context of a site-safety enquiry — and only where reasonably necessary and with your consent, in accordance with APP 3.

3. How We Collect Personal Information

We collect personal information directly from you, where reasonable and practicable, through:

  • Phone calls, SMS and WhatsApp messages to +61 404 713 949;
  • Email correspondence, including to info@everestscaffoldingsolutions.com.au;
  • Our Facebook and Instagram pages, and lead generation ads run on Meta and Google platforms;
  • In-person conversations, site visits and quote inspections;
  • Job applications and recruitment enquiries.

We may also collect personal information from third parties (for example, a builder, contractor or property manager referring a project to us), or that is publicly available, where this is reasonably necessary for our business activities.

4. Why We Collect, Hold, Use and Disclose Personal Information

We collect and use personal information for the following purposes:

  • Responding to quote requests and enquiries, and preparing proposals;
  • Scheduling, delivering, installing and dismantling scaffolding and related structures, and managing site logistics and safety;
  • Invoicing, payment processing and account management;
  • Marketing our services, including via email, SMS, WhatsApp and social media advertising (Meta/Google), where you have consented or where permitted under the Spam Act 2003;
  • Improving our website, services and customer experience, including through analytics;
  • Complying with our legal, work health and safety, and regulatory obligations; and
  • Assessing employment or subcontractor applications.

We will only use or disclose personal information for a purpose other than the primary purpose of collection where permitted under APP 6 (for example, with your consent, or where required or authorised by law).

5. Disclosure of Personal Information

We do not sell your personal information. We may disclose personal information to:

  • Our staff, subcontractors and site personnel involved in delivering a project;
  • Our marketing agency, The Ideas Factory, which manages our digital advertising, website and lead-generation campaigns on our behalf;
  • Service providers that support our operations, such as website hosting, form and CRM tools (including WPForms), accounting and payment providers;
  • Platform providers used for advertising and communication, including Meta Platforms, Inc. (Facebook/Instagram/WhatsApp/Meta Pixel and Instant Forms) and Google LLC (Google Ads, Google Analytics, Google Maps);
  • Professional advisers (legal, accounting) where reasonably necessary; and
  • Regulators, law enforcement or other parties where required or authorised by law.

Where we engage third-party providers, we take reasonable steps to ensure they handle personal information consistently with this Policy and the APPs. We do not otherwise share personal information with unrelated third parties for their own marketing purposes without your consent.

6. Overseas Disclosure of Personal Information (APP 8)

Some of the service providers referred to above — including Meta Platforms, Inc. and Google LLC — store or process data on servers located outside Australia, including in the United States. Before disclosing personal information overseas, we take reasonable steps to ensure that overseas recipients handle that information consistently with the APPs, including relying on the privacy and security commitments published by these providers.

By submitting information through a Meta lead form, Facebook/Instagram ad, or Google Ads form, you acknowledge that your information may be processed by these platforms outside Australia in accordance with their own privacy policies, in addition to this Policy.

7. Cookies and Tracking Technologies

Our website uses cookies and similar technologies (including the Meta Pixel and Google Analytics/Google Ads tags) to:

  • Understand how visitors use our website;
  • Measure the performance of our advertising campaigns; and
  • Improve website functionality and user experience.

Most browsers allow you to control or disable cookies through their settings. Disabling cookies may affect how our website functions. Where required, we will seek your consent to non-essential cookies through an on-site notice.

8. Direct Marketing

We may send you marketing communications by email, SMS or WhatsApp, or show you advertising on Facebook, Instagram or Google, in accordance with APP 7 and the Spam Act 2003 (Cth). We will only send commercial electronic messages where you have consented (including inferred consent from an existing relationship or a quote request) and every message will include a functional unsubscribe facility. You can opt out at any time by:

  • Clicking “unsubscribe” in any marketing email;
  • Replying “STOP” to any SMS or WhatsApp marketing message;
  • Emailing info@everestscaffoldingsolutions.com.au; or
  • Adjusting your ad preferences directly within Facebook, Instagram or Google.

If your number is registered on the Do Not Call Register, we will not contact you for marketing purposes by telephone in breach of the Do Not Call Register Act 2006 (Cth).

9. Data Storage and Security

We take reasonable steps, in accordance with APP 11, to protect personal information from misuse, interference, loss, and unauthorised access, modification or disclosure. These steps include:

  • Restricting access to personal information to staff who need it to perform their role;
  • Using secure, password-protected systems and reputable third-party platforms (e.g. WPForms, Google, Meta) with their own security safeguards;
  • Reviewing and updating our security practices from time to time.

We retain personal information only for as long as reasonably necessary to fulfil the purposes described in this Policy, or as required by law (for example, for taxation or work health and safety record-keeping), after which we take reasonable steps to destroy or de-identify it.

10. Data Breaches

If we become aware of a data breach that is likely to result in serious harm to an individual whose personal information is involved, we will comply with our obligations under the Notifiable Data Breaches (NDB) scheme in Part IIIC of the Privacy Act, including assessing the breach and, where required, notifying the Office of the Australian Information Commissioner (OAIC) and affected individuals as soon as practicable.

11. Access to and Correction of Your Personal Information

Under APP 12 and APP 13, you may request access to the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading. To make a request, contact us using the details in section 14. We will respond within a reasonable period (generally within 30 days) and may need to verify your identity before releasing information. In limited circumstances, we may decline a request for access or correction, in which case we will explain our reasons in writing.

12. Automated Decision-Making

We do not currently use automated decision-making (including AI tools) to make decisions that have a legal or similarly significant effect on individuals. If this changes, we will update this Policy to disclose the relevant automated processes, consistent with amendments to the Privacy Act that take effect from December 2026.

13. Children’s Privacy

Our website and services are directed at adults engaging construction, renovation and maintenance services, and are not intended for children. We do not knowingly collect personal information from individuals under 18 without appropriate parental or guardian consent.

We may update this Privacy Policy from time to time to reflect changes in our practices, our services, or Australian privacy law (including the reforms scheduled to take effect through December 2026).
